A Dhaka court has sentenced Evaly Managing Director Mohammad Rassel and his wife, Evaly Chairperson Shamima Nasrin, to two years of imprisonment in a case filed over fraud.
Dhaka Metropolitan Magistrate Partha Bhadra delivered the verdict on Wednesday, fining the two Tk10,000 each, with an additional two months of imprisonment in case of non-payment.
The court also issued arrest warrants against them.
The case originated from a complaint by Toufiq Mahmud, who had ordered a Yamaha R15 bike from Evaly on March 20, 2021, after being attracted by Evaly’s advertisements.
He paid Tk2.45 lakh but never received the bike.
On April 3 that year, he placed an order for two more R15 bikes, paying Tk5.9 lakh with a promised delivery time of 45 days.
However, Evaly failed to deliver the bikes.
When Toufiq approached Evaly’s Dhanmondi office, the company provided him with post-dated cheques, requesting that he delay depositing them due to insufficient funds.
Trusting their assurance, he complied.
However, when he later demanded his Tk14.1 lakh refund, neither Rassel nor Shamima returned the money, according to the case statement.
After multiple unsuccessful attempts, including a legal notice, Toufiq Mahmud filed a fraud case against the duo on February 4, 2024.
