Proposal to make Info Commission constitutional body

A proposal has been made to establish the Information Commission as an independent constitutional body to ensure its autonomy in strengthening democracy.

The recommendation was presented at a press conference titled “Functionality of the Information Commission and Amendments to the Right to Information Act”, organized by the Information Rights Forum at the Transparency International Bangladesh (TIB) office in Dhanmondi on Thursday.

The forum also proposed several amendments to the Right to Information (RTI) Act, 2009 to enhance the commission’s effectiveness.

Speakers at the event criticized the government’s inaction in appointing a commissioner, noting that the Information Commission has been non-functional for the past six months.

In a written statement, MRDI Executive Director Hasibur Rahman emphasized that the Information Commission should have constitutional recognition, perpetual succession, and the authority to acquire, hold, and transfer both movable and immovable property.

To maintain the commission’s effectiveness, the forum proposed ensuring the timely appointment of the chief information commissioner and other commissioners with qualified individuals.

Regarding the formation of the commission, Hasibur Rahman said: “While parliament is in session, one member of the ruling party, nominated by the speaker, and one opposition member should oversee appointments. If parliament is not in session, a judge nominated by the head of the selection committee and a representative from the Information Rights Forum should take charge.”

Additionally, the forum proposed appointing the chief information commissioner within 45 days if the position becomes vacant.

Another key proposal included aligning the rank, remuneration, and benefits of information commissioners with those of high-ranking government officials, as well as setting clear rules and procedures for their removal.
