HC hearing held on writ challenging July fighters’ immunity ordinance without constitutional reform

A writ petition has been filed in the High Court challenging the legal validity of the ordinance issued by the interim government granting immunity and legal protection to participants of the July Uprising without undergoing prior constitutional reform.

The petition also seeks a rule asking why granting immunity and legal protection to July movement participants without amending or reforming the constitution should not be declared illegal.

A High Court bench led by Justice J.B.M. Hassan held a hearing on the writ on Wednesday (September 2). Following the initial arguments, the court fixed next Sunday for the subsequent hearing.

Nurul Huda, a participant in the July movement and brother of Syed Major Bazlul Huda, filed the writ petition. Barrister Shahriar Kabir represented the petitioner in court.

Five respondents have been named in the petition, including the Secretary of the Parliament Secretariat, the Law Secretary, and the Cabinet Secretary.

The petition contends that the initiative to grant immunity and legal protection to July movement participants was taken solely through the promulgation of an ordinance, without establishing the necessary legal foundation via constitutional amendment or reform. The core challenge in the writ centers on the legality of this approach.

The writ further asserts that while efforts are underway to protect July movement participants from various legal proceedings—including civil and criminal cases—granting such immunity requires a sound constitutional and legal basis.

The application expressed concern that conferring immunity and legal protection without constitutional reform could leave the measure vulnerable to future legal challenges in court.
